Many people come to the United States on a visitor, work, or dependent visa and later decide they want to study English full-time. If that describes you, changing your nonimmigrant status to F-1 student status may allow you to pursue your goals without leaving the country. Here is what the process looks like.
A change of status lets you switch from your current nonimmigrant category to F-1 student status while remaining in the United States. Instead of returning to your home country to apply for a student visa, you file the request with U.S. Citizenship and Immigration Services (USCIS) and wait for approval before beginning your studies.
First, apply to and gain acceptance at an SEVP-certified school. As an SEVP-certified English language school, American English Language School in Fullerton can issue you an initial Form I-20, with "change of status" listed as the reason.
Next, pay the I-901 SEVIS fee to activate your student record. Then file Form I-539, Application to Extend/Change Nonimmigrant Status, with USCIS. You can submit it online or by mail, but it must be filed before the expiration date shown on your Form I-94 arrival record.
To qualify, you must have been lawfully admitted, currently hold valid status, and have no status violations. Travelers who entered through the Visa Waiver Program are not eligible to change status inside the country. M-1 vocational students also cannot switch to F-1 while in the U.S.
Timing matters. If your current status does not permit you to enroll in classes, do not begin studying until USCIS approves your application. If a decision has not arrived about 15 days before your program start date, contact your school's designated school official (DSO) to discuss deferring to a later term.
