For many years, F-1 students were admitted to the United States for Duration of Status, often shown as D/S on the I-94. This meant students could usually stay in the U.S. as long as they maintained their F-1 status, kept a valid I-20, and continued their approved program.
However, the U.S. Department of Homeland Security has published a final rule changing this system. The new rule is scheduled to take effect on September 15, 2026. After that date, F-1 students will generally be admitted for a fixed period of time instead of D/S.
Under the new rule, the student’s authorized stay will be based on the program length listed on the Form I-20, up to a maximum of four years, plus a short period for arrival and departure. Students who need more time to complete their program, begin a new program, transfer, or apply for OPT may need to request an Extension of Stay through USCIS or depart and reenter the United States with a new admission period.
This change makes the I-20 program end date even more important. Students should not wait until the last minute. If your I-20 is ending soon and you plan to continue studying, you should speak with your school’s DSO before the program end date.
Current F-1 students who were admitted under D/S before September 15, 2026 may have special transition rules. According to DHS information summarized in the final rule, students already in the U.S. under D/S may remain until the program end date listed on their I-20, or the end of OPT or STEM OPT, subject to the limits in the rule.
The rule also includes changes related to school transfers, change of education level, change of major, and the departure period after completing a program. Because these changes may affect each student differently, students should review their situation carefully with their DSO.
